Gibson, William John - 5th. February 1910 - A lodging house keeper of Movilla Street - Was charged in court that on that date with assaulting and causing serious bodily injury to Agnes Girvan. Mr.Alexander Stewart appeared for Mr. Gibson. Dist.Insp. Lennon said that he understood that Girvan had absconded and she was the principal witness. The case had been adjourned from the Petty Sessions but there was no further evidence to be given. He would not have objection to the charge being reduced to one of common assault if the defendant would plead guilty so as to enable the case to be disposed of but otherwise he would have to apply for a warrant for the arrest of Mary Girvan. The whole case was ready to go forward to the Quarter Sessions. He understood that since last Court appearance Girvan had gone back to Gibson and was living with him. The case was adjourned to next court, the defendant being allowed out on same bail of himself £20 and two sureties of £10 each.
The case reconvened in March - Sgt. McLaughlin deposed that on 28th. February about quarter past 10.00 o'clcok he went to the house of James Crothers on Movilla Street, he found Agnes Girvan there sitting on a couch, her hair was a mass of blood, her face, hands and breast were also covered in blood. He was present when Dr.Jamison examined the wound on her head on which there was a clean cut across the top, apparently about 3 inches in length and the skull was exposed. In consequence of the statement Girvan made and what the doctor told him, witness went to the prisoners house and arrested him on a charge of seriously assaulting Agnes Girvan that morning and placing her life in danger. He gave Gibson the usual caution and in reply Gibson said "She wasn't in the house last night, wherever she got it, it wasn't here" . In light of what Girvan told him the witness searched a corner of the kitchen and found a hammer {produced in evidence} and took possession of it. He also found a pair of bellows {produced} on which were fresh streaks of blood. In another part of the kitchen he found a floor brush {produced} on the handle of which he found blood stains. There was a hatchet under the cupboard but witness did not take possession of it. In the cupboard there were a number of apparently freshly emptied porter bottles. He went upstairs and at the top he noticed on the floor a few drops of blood. Afterwards he examined the gateway into Gibsons yard a fews hours later. The gate was a boarded door opening in the centre and swings to either side fastened by a long wooden bar on the inside. On the bar he also found blood stains. About 3 or 4 feet from the ground there was an opening from where it was possible to see into the yard.
Mr. Stewart: What is your reasoning for mentioning this opening.
Witness: I have reason to mention the fact in evidence
Clerk: It's likely someone will say they saw something through it.
Mr.Stewart: Do you swear that the blood stains were all, or any from Agnes Girvan
Witness: I can only swear that i found them there
